WHAT YOU GET:
Each person will receive a gallery of expertly edited images with multiple dynamic poses, along with a code to download their 8 favorite photos from their gallery. These images are high resolution and can be used for prints or sharing on social media.***Additional downloads, including a full gallery download and high-quality prints, will also be made available for purchase at a discounted rate.

Terms & Conditions

The retainer is NON-Refundable.

If a balance is owed, it is due 3 days before the session date. Lack of payment in full will result in a forfeit of your session.

HOSTING:
Lacey M. Carroll Photography hosts your photo for 30 days after the date of delivery. After 30 days, your gallery will expire and to re-host your gallery I ask that you provide a $10 re-upload and hosting fee per month of live gallery hosting.

STORAGE:
Lacey M. Carroll Photography only agrees to store digital copies of your entire gallery for 6 months. After 6 months your photos will be purged from the hard drive, with the exception of any photos used for promotional purposes for Lacey M. Carroll Photography which is at the discretion of the photographer. If you would like Lacey M. Carroll Photography to store your photos for any period longer than 6 months a fee will be incurred based on the size of your gallery ranging from $10 - $100 per 6 month period.

WEATHER:
Sessions will take place RAIN or SHINE. In the event of inclement weather, sessions will take place in another location. Clients will be informed of the change approximately 24 hours before the session is to take place.
CONTRACT

Fees

Fees I understand that I am required to pay the session fee in order to secure my spot. If the session fee is not paid, my time slot cannot be guaranteed. I understand that session retainers are non-refundable. Session and Package fees do incur a sales tax fee based in Sacramento County my studio is located.. This signed contract and the retainer deposit are required to book the portrait session and purchased package.

Carroll Photography the right to use all digital negatives and/or reproductions from my photo session for display, publication, related website and blog use, contest entry, and/or peer review. I understand that although I have personal use rights to print and share the images which result from my session in any way for my own use only, they remain the intellectual property of Lacey M. Carroll Photography.

I will be granted a print release for personal use of my images, however they may not be cropped, edited or altered in any way. Doing so is an infringement of US Copyright Law (USC Title 17), for which fines begin at $5,000
Session Information

Session Information This contract is written for the purpose of personal portraits. The signing of this contract states the client’s understanding that it is their choice to participate in these photos, and the client will not hold Lacey M. Carroll Photography herein after referred to as PHOTOGRAPHER responsible for any negative actions or feelings that may commence due to the images of this photoshoot. The client understands that they will decide whether or not these images are made public, and will make PHOTOGRAPHER aware of these preferences. Based off the print/product agreement the client is agreeable to the terms, conditions, and timeline of the session, and the delivery of images and products. The client states that they are 18 years or older. If the client is not 18 years or older, they understand a parent or legal guardian is required to sign this contract as well.
Reshoot Policy

Reshoot Policy CLIENT understands that no Reshoots are given for Mini-sessions. If CLIENT no-shows they will lost their place and non-refundable retainer fee. Mini-sessions are only re-shot, or continued due to Inclement weather, acts of god or artistic preference of PHOTOGRAPHER.
Purchase of High Resolution Files

Purchase of High Resolution Files Upon final payment by the CLIENT, CLIENT will have printing rights of the resulting images. CLIENT is obtaining digital files for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than PHOTOGRAPHER. If CLIENT is obtaining digital files for publication purposes, PHOTOGRAPHER shall request that a credit for PHOTOGRAPHER be placed adjacent to the photograph on publication, but shall have no liability if the publication refuses or omits to do so. Images will be transferred to the CLIENT under the following conditions: the negatives are the property of the CLIENT for personal use only and the purposes of reproduction (printing). Use for contests, advertising, promotion, marketing and packaging, text and graphics, cropped, altered or modified IS STRICTLY PROHIBITED. The CLIENT must obtain written permission from PHOTOGRAPHER and compensate PHOTOGRAPHER prior to an event where the CLIENT, the CLIENT’s friends and/or relatives publish or sell the photographs. Any use of digital images on social networking sites such as Facebook, Twitter, or blogs, must contain PHOTOGRAPHER’s watermark to prevent theft. CLIENT understands that the purchase of high resolution files does not allow an COPYRIGHT holdings to CLIENT and all COPYRIGHTS remain with PHOTOGRAPHER.
DISCLAIMER

DISCLAIMER If you would like to purchase additional products or prints, please visit your gallery website. Prices are subject to change at any time without client notification. This contract solidifies the package contents and price at the time of booking. This contract is specifically for services and products purchased on purchase date. If products are purchased after gallery is closed, and prices have changed, products will be priced at the current price, not the price at booking.
Camera Exclusivity Rules

Camera Exclusivity Rules PHOTOGRAPHER requires that no other professional grade photographic or video recording devices be present during the session. This may affect the results of the session. If another camera is present and being used by someone that is associated to clients, or by clients, the session may be canceled, cut short, or the person with the camera may be asked to leave.
Cooperation

Cooperation PHOTOGRAPHER is not held responsible for behavior of parties involved with the shoot, with the exception of studio personnel. If the desired outcome of your session is jeopardized by the behaviors of parties involved with the exception of PHOTOGRAPHER’S studio personnel, PHOTOGRAPHER cannot be held responsible.
Editing & Image Presentation *

Editing & Image Presentation * Upon hiring Lacey M. Carroll Photography, client understands the style of photography and editing that PHOTOGRAPHER does. The creative session fee covers all editing. All images are processed with PHOTOGRAPHER’S signature post processing. Minor retouching such as skin smoothing, removal of unsightly items in the photograph, and adjusting colors are all to be done with photographer's personal discretion. Clients are allowed to ask for only ONE minor adjustment, such as head swaps, color tone change that does not stray from photographer's style, or anything that can be quickly fixed with the spot heal, or clone tool in photoshop. Any requests for re-editing after the first re-editing will be charged an additional fee. Re-editing fees start at $50.00 per image depending on client requests.
Completion & Delivery

Completion & Delivery Due to the nature of these sessions, completion and product delivery time may vary. Please refer to the product/print order contract for specific completion times and dates for your purchased products. Average completion time is 25+ business days. If your session falls on a weekend, your session will be delivered on a weekday. If client would like the images to be completed sooner than the regular turnaround time, there is a rush charge of $100.00 to complete the images before the regular turnaround time. If your session falls over a holiday or busy season PHOTOGRAPHER will tell you when to expect your images.
Completion & Delivery

Completion & Delivery If CLIENT is tardy, due to the nature on MINISESSIONS the CLIENT may end up shortening or forfeiting their session entirely at the PHOTOGRAPHERS discretion.
